Those are cool pictures, it’s such an iconic place. Interesting notes on the copyright issues, I had no idea.

Brian Meeks make an excellent point. I can’t copyright of the Eiffel towers light show. And due to a special law it has the same rights as a person has. that is – One cannot sell photographs of it for commercial use without them authorizing it. this is the same the rights any human has. You are not allowed to take a photo of someone and then use it in an ad-campain etc without their permission. this is taken care of by so called model releases when it comes to humans. However It is fully legal to take photos of people and buildings for editorial use (read: for articles in the press etc). Such photos are still copyrighted and the ones who takes them (and as such hold the copyright of the photo) can decide who can publish them.

And I have not given this blog permission to use my photo.

i hav no idea abt the law bt the pics are simply marvelous..its amazingly caught..the lights looks like diamonds especially the 18th picture is amazing with the fireworks beside ..great timing and beautiful shots..

I think Dan has an excellent point as well. Though I think he too has missed the point. All of those photos with the “Copyrighted” all rights reserved are a problem. The photographers, unless expressly given written permission from Credit Foncier, are themselves in violation of copyright laws.

The photographers can’t copyright another persons work. Just because Dan took a wonderful picture, he can’t claim any copyright, because the light show (read: Eiffel Tower at night) is protected.

It would be the same as taking a photograph of painting and claiming copyright. No, the painter has the only copyright.

So ultimately I believe, and I am not an expert, that both Dan (for claiming copyright) and this website, for using the images, are both violating the rights of Credit Foncier.

I do some stock photography. It is my understanding that it is the ‘light show’ that is copyright protected. The owners are protecting their rights to sell post cards, posters, ect. I can understand that.

The Eiffel Tower is operated by Société Nouvelle d’Exploitation de la Tour Eiffel (New Eiffel Tower Operating Company), which is a subsidiary of Crédit Foncier, a large French bank.

Other protected buildings…

…The Opera House in Sydney and all of Frank Ghery’s buildings. I am sure there are more, but those two come to mind.

This copyright discussion is inetresting but you seem to have missed a very important point here.

Regardless of what the French law states of photos of the eiffel tower a lot (all?) of the photos used in this article are copyrighted “All rights reserved” That means that you need the artist/photographers consent for them to be used. I don’t know whether or not the other photographers have been asked but I have not been asked at least and I have taken one of the photos and have not given my consent to use it here. If the same is true in the other cases this article has up to 27 copyright infringements in it…

Often photographers give permission to use photos if you ask them kindly, but you should ask before using them.
